Legal Question in Family Law in Virginia

I have already paid to have uncontested papers filed. My husband has refused to sign although he said he would. I am not asking for anything, There is no dispute over the marital property because I want none of the marital property. He can have it all. Child support has already been established. I want nothing but a divorce. Due to no fault of my own my divorce has had to be withdrawn due to health issues with the attorney, he can no longer proceed. So now I'm out of the money that I paid. What can I do?

So, if you've already paid for services to an attorney who is not now in a position,

to provide them, you should be asking for at least a partial refund of the fee which

has not been fully earned (which in fact might be the entire sum which you've paid).

Then you may wish to consider engaging the services of another lawyer who

will finish the job whether your husband agrees to sign the papers or not.
