Legal Question in Family Law in Virginia

time for discovery

My boyfriend and his ex are going through a divorce. The divorce has been set for trial. Yesterday we received papers from my boyfriends ex's lawyer requesting documents that are going to be presented to the court in the divorce hearing. We understand that he has to comply with the request however she is expecting him to produce these documents in 21 days. Some of the documents such as tax returns and W-2 for the past five years we do not have access to. He also has a counterclaim for a loan his ex is responsible for and will not be able to get copies of checks that she has written him towards the loan and bank statements with in that time. Is it possible to ask for an extension of time to get these documents.

Re: time for discovery

Your boyfriend needs to discuss these issues with his attorney. If he doesn't have one, he needs to get one immediately.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
