Legal Question in Family Law in Virginia

My ex wife just got arrested for assault and battery and I currently have my son with me now. If I refuse to let him go back to her because he's better off with me would the courts view this as me keeping him from her in a custody battle which would reflect negatively on me

No, as long as you would not be violating any current custody order,

I doubt that your keeping your son as you've suggested (at least

for the short term) based upon the facts described would create any serious future problems with respect to any custody litigation which might ensue at some time in the future between you and this boy's

mother.
