Legal Question in Civil Litigation in Virginia

I was in an accident in which the other driver ran a red light and hit me. The other driver was given a ticket. The car was towed to a body shop. No one was injured.

Here is the question? The estimate to fix the car is more than the car is worth. I am not in a position to buy another car with the small amount of money the insurance company will give me.

Any suggestions?

You are not going to recover more than the fair market value of your vehicle

at the time of this accident whether you decide to sue the driver responsible for your damages or accept what his insurance company is willing to offer.in settlement.

The fact that such an outcome may not put you in a position "to buy another car" is

essentially irrelevant to the salient legal issues in the case (in my opinion).
