Legal Question in Civil Litigation in Virginia

Compensation for loss of value

I was involved in an accident where another driver was at fault. She was issued a citation at the scene. My car was blue-booked at around $13,000 but due to the accident will be worth considerably less now. Although the insurance company will likely pay for repairs etc, can I sue for the loss in resale value?

Re: Compensation for loss of value

You are entitled to the loss of value or the cost of repair (unless the car is "totalled"), whichever is less, and you're entitled to one or the other, not both.
