Reporting a minor in consumption

When I was 18 I was ticketed for a minor in consumption in South Dakota. I am now 21 and am applying for a job in Virginia. On the application it asks: ''Have you been convicted of a crime in the last 10 years or are there charges presently pending against you for any crime other that the above traffic offense(s)?''

The application is for an airline position. I understand that this employer makes a background record check.

My question is is that minor conviction still on my record and do I have to report it on the application.

If it is a conviction, you have to report it. You would be lying by not reporting it even if it was not caught by a computer search. Given the sensitive nature of airline jobs, a false statement would be seen as much worse than a drinking incident as a minor.

If this was a misdemeanor offense in South Dakota and you received a Suspended Imposition of Sentence(SIS)or its equivalent such as Probation Before Judgment(PBJ) where you entered a plea of

guilty but there was no conviction,then(assuming you complied withthe terms of your probation),the

case would've been dismissed, there would be no record of a conviction, and, therefore, you would not have to report it.

However, if your minor in consumption charge was a

misdemeanor offense of which you were convicted without the the benefit of the remedies described above,then in all probability it's on your record and must be reported.
