Is a non-compete agreement enforceable after a company merger? Note: I resigned after merger and did not sign the new non-compete agreement under the new company.

Yes, the non-compete is probably still enforceable if the new company as a result of this merger assumed the old company's rights as well as its obligations (my opinion).
