Legal Question in Landlord & Tenant Law in Virginia

Mother Will not move out.

My mother moved in aprox 9 months ago. She pays no rent or bills here. Due to domestic disputes and the police have been to my home on 2 occasions, she refues to leave. She works for attorneys and has more info than me on these laws. What do steps do I have to take to evict her. (I do not own the home, I am the only lease holder).

This is actually a very difficult situation. I have seen people standing in front of the judge in situations like this, and the judge saying "I can't help you." The reason is that your mother does not have a lease. On the one hand, your mother has NO rights to your apartment. For examlpe, you could simply change the locks any time you want. She has zero rights. On the other hand, all of the laws and mechanisms set up to deal with getting tenants out of your apartment are based on a lease. You could change the locks. You could sue her for trespassing. You could even call the cops and say she is trespassing, if you want to take it that far.
