Security Deposits

A resident lived at one apartment in our community, then transferred. He is due a refund from the first apt. he moved out of on 12/18/04. We mailed his refund to his 1st apartments address and it has just been returned undeliverable. He is currently in process of eviction for the 2nd (transferred) apartment for non payment of rent. Can we use that refund check from 1st apartment towards debt in 2nd apartment?

If there's a new lease in effect for the second apartment, then the refund(presumably for a security deposit)should be returned to the tenant in accordance with what the terms of his first lease undoubtedly require.
