Legal Question in Legal Malpractice in Virginia

Corp. lawyer loyalty questioned?

I am a 49% shareholder in my fathers business. I have been on the bod for over 25 yrs. My father died and left everything to my stepmother. The corp lawyer of over 15 yr. stated that he was the corp. lawyer and could not represent HER or US. Later we found out that my stepmother talked the lawyer into representing her . The lawyer told me that she could fire me. My stepmother took over and put herself on the payroll, falsified documents , kept financial records from me etc. The supposed corp. lawyer apparently allowed this. This all happened before her shares were distributed. She now has the shares and I now have a suit against her, She is still playing dirty and now using corp funds to pay for her defense While I am left with over $60,000 in legal fees and don't even have a job in my own business. I worked my fingers to the bone for over 20 years and now she is trying to take it all.Is this a case for legal malpractice

Re: Corp. lawyer loyalty questioned?

Yes, the situation you've described could possiblly involve legal malpractice on the part of the corporation attorney, fraud/forgery on the part of your stepmother and who knows what else?

Hopefully, your pending suit will shed at least some light on these matters which will allow for an appropriate measure of justice to be brought to bear on them.
