Legal Question in Personal Injury in Virginia

Summer Camp Waiver of Liability and Assumption of Risk

I'm planning to have my child attend a summer camp run by a fitness club. On the back of the participation agreement form, are two paragraphs regarding waiver of liability and assumption of risk.

Basically, the fitness club wants parents/legal guardians to waive liability and assume all risks, even if the fitness club is negligible. If I sign the participation agreement form, am I really waiving all rights to hold the fitness club accountable, even if they're at fault due to negligence, or is this a tactic to attempt to ward off lawsuits?

Re: Summer Camp Waiver of Liability and Assumption of Risk

Your latter surmise is the correct one i.e., camp's attempt to ward off lawsuit. However, I can tell you that it won't work(for public policy and other reasons)and that if camp staff is truly negligent, the waiver form will not save the organization(or even individual staffers) from a lawsuit.
