Traffic Accident

While a friend, Adam, was fully legally driving on a curved uphil of two lane State Highway, an incoming bus skided into his lane (wrong), and resulted in a total damage of his car and Adam's back injury. Adam has iability insurance policy only. Adam's medical bill, but not the loss of his car, was covered by his insurance policy.

The insurer of the bus driver declines to pay the compensation because the bus driver could not avoid it because of oil spillage on the road.

Question: When any person causes accidents on a public highway is undrivable road conditions such as unexpected oil spill on the road, is he free from liability to property damages?

This is typical insurance company baloney---stonewalling the victim and refusing to pay even reasonable claims in order to protect the company's bottom line.

Of course, most roads have oil deposits upon them,

but drivers are expected to operate their vehicles in such a manner, that if they encounter one of these slick spots, they will, nevertheless,

be able to maintain control of their vehicles and prevent them from causing damage to others.

Your friend should retain an attorney to initiate

suit against the driver and his company for all

of his damages from this collision which remain unpaid.
