ok my friend, the driver, at my school had six people in her jeep cheerokee. She told the sixth person not to sit in the trunk compartment and she sat back there anyway, leaving the driver not knowing because the trunk door was closed. well as we began to start moving the driver lightly tapped the gas and the jeep slightly jumped up and the door to the trunk opened the sixth passenger fell out at about 5-10 mph and had no minor injuries but a open cut not even an inch and a possible twisted ankle. Can you tell me whose fault it is and if there is a penalty.

From a traffic law/offense standpoint, I don't believe there is a traffic offense here. If the driver did not know the person was in the rear. Now the civil question is another matter. Did the driver breach a duty of care, was she negligent in the operation of the vehicle? Questions to put to
