Legal Question in Wills and Trusts in Virginia

No will

I was living with someone who passed away who did not have a will. I get bills at th address but did not pay any rent etc. His family and POA will not let me take my furniture and items which are in the house. They told me if I come back onto the property then will charge me for trespasing and breaking a entering. Can I go in and get my stuff?

Re: No will

No, but you can go to your local general district

court and file what's called a Warrant in Detinue for the return of your property, and, in the alternative, request that a judgment be entered against these wrongful distrainers in the amount of its fair market value (if for some reason the property cannot be returned).
