Legal Question in Civil Rights Law in Washington

I bought a car from a lot in Lynnwood, WA I bought it as is but that was only because it had a so called 150 point inspection. After two weeks the transmission went out. When I brought it back to the car lot they said that they would fix it but I have to give them half the cost. I declined that offer and brought it to a transmission shop and the guy said that the trans had a "long term problem that they would have never been able to pass a test. They probably knew it had a problem." do I have any rights here?

In short, no. Although a lot depends on your purchase and sale agreement to buy the car, typically, these assign all the risk in the transaction to you, the buyer. Additionally, the car dealer will always say that they offer you the right to have their cars inspected at your cost, by an independent mechanic.

The 150 point inspection could refer to anything. It is up there with "fluff advertising" at its best. They could inspect 150 points on all four tires, or 150 points, except anything to do with the transmission. Even if they did inspect the transmission, which you will need to get in writing that they inspected it and it passed, and on what date, but even then, the burden will be on you to present a mechanic who says that if they inspected the transmission, he can say with certainty, that they would have discovered the issue at hand.

At the end of the day, I am sorry, I do not think you have a case. Buying used cars is risky business, which is why the prices tend to be so much cheaper. If you really want to do it right, and this is by no means a guarantee, but it is better than what you didalways, always, take the car to an independent mechanic who will look at it for $50-$100 and give you an honest workup of what they think is wrong. You can then take that written workup to the dealer and use it to negotiate the price down, or better yet, as in this case, walk away unless they pay to rebuild the transmission at a shop of your choice. It is way better to be out $50-$100 than to have a lemon as you do now.
