Should I sue their bond? Will it do me any good?

We hired a contractor May 05 to do a major remodel to our home. The job was to be completed Sep. 05 It is now 9/06 and it still isn't done. The contractors are no longer licensed as it was pulled in 10/05 without telling us. Their is major defect in their work that they won't repair. Also major repair work to be done to the existing structure from damage. The contract we signed says they will make all these repairs, that ''time is of the essence'', that they warrant their work for 4 years. They are now wanting us to pay more, sign new contracts and pretty much refusing to finish the job. Should we sue their bond? How does that work-pay for the work to be done by someone else and hope that we are reimbursed by their bond co.?

You should consult an attorney and consider suing (1) all contractors involved (2) all of their insurance companies, and (3) all of their bond companies. You should also not sign any more contracts until seeking legal counsel and you should talk to counsel about filing a complaint with the state contractors' board.
