It depends. The words "ex parte" mean only one side to a legal matter was represented in court and spoke with the judge. The judge was told something about the case before the court and thereafter issued a court order. The sheriff return on a bench warrant language refers to a bench warrant issued for a person's arrest and may refer to someone having been taken into custody and the bench warrant that had been issued and outstanding until the particular court hearing was then returned upon the appearance of the person before the judge.
