Legal Question in Civil Litigation in Washington

restraining order

neighbors son (over 18) came to my back door. He asked if he could use the phone. I opened the door and let him use the phone (this has happened before, he gets locked out of his house). Once I gave him the phone, he lowered his pants, exposed his genitals and started masturbating. He did not touch me or approach me. I asked him several times to leave and he backed out the door. I locked the door and called 911. The police knew this person by name and have arrested him before. They said this was the first incident that was sexual in nature. They took him to jail and took a statement from me. They suggested I file a restraining order? We are in Pierce Co. (Lakewood). We have 4 small children here. They were not in the room. My husband was at work. I want to make sure that this restraining order is permanent and restricts him from my entire family. My son walks home from school. My kids play in my backyard. We feel totally violated. What recourse do I have?

Re: restraining order

I would say a restraining order is definitely in order. I think given what you have described, as long as the judge believes you, you have a very good chance of obtaining a restraining order. As to the duration, I cannot say for sure, although asking for a lifetime duration is not out of the question. I'd want to know more about what happened with that police report and what his criminal history looks like and how if at all, if relates to what he did to you.
