Sueing and serving papers

My mom is being sued, when the person came to serve the papers he gave them to someone else in the house besides her. Is that legal?

Yes it is. The rules allow for service to be made in

many ways, including leaving the papers at a person's

home with someone of "suitable age and discretion then

residing therein." Which means the papers cannot be left

with a small child or someone who is obviously suffering

from a mental illness or handicap. But if someone were

to serve papers to me by delivering them to my teen-age son,

service would be proper.

If your Mom has an attorney, then service on your Mom or someone

at her home is not proper ... service should be upon her

attorney.
