For what? I do not mean to sound rude, but based on the limited facts available here there doesn't appear to be any "damages" in the legal sense of the word. He "tried to kick down..." implies that he failed, and since you didn't state any damage to the door, which is probably not your door anyway, there wasn't harm there. When you say assaulted you might mean that you were physically injured in which case you may have a claim that would be worth pursuing. Again, however, you didn't mention you were hurt, so I assume that you were not physically hurt.

Since the apartment complex evicted him for this behavior it probably complied sufficiently to escape any liability. Hate to deliver bad news, but that is what I think are the appropriate legal principals based on limited facts available. Be careful, however, of violent drunks. If you feel your safety is in danger contact the police and perhaps an attorney to get a protection order/restraining order/no harassment order.

My statements are merely statements of legal principals and do not constitute legal advice. Legal advice requires careful examination of all surrounding facts and application of the law to them. Furthermore, no attorney-client relationship is formed by my statements.
