Car Accident

In May 2006, I was involved in a three car rear collison. Vehicle 1 caused the accident and was uninsured. Vehicle 2 struck me after being struck by vehicle 1. I was injured in the accident and had to have knee surgey. I settled with my insurance company for the insured driver but did not pursue a claim with the driver of car 2. My knee is acting up again. Can I file a claim against the insurance company of the driver of car 2. If yes, is there a statute of limitations in WA state?

The statute of limitations is generally three years in Wa. There are exceptions depending on who is at fault, such as, a federal governmental agency employee or otherwise.
