Legal Question in Personal Injury in Washington

It happened last night. My friend, his friends and I were at local lounge. We had some drink except his driver, and we were drunk. And then when he tried to carry me by his back, he didn't try to hold me tight enough, he dropped me on the concrete ground. About four of my teeth were broken, I got bruise and scratch on my chin, I had to have wire around these teeth at emergency room. I'm not sure what to do.

Because all of this happened, I am very embarassing to go outside, not even one second, because of my teeth and wounds. He doesn't sound like he's going to pay, and he's not even sorry.

Can I sue him? If I can, how much average cost can I get?

I don't think you have a very good case against the guy who dropped you because you were drunk as was he, and so while he was negligent in the way he handled you on his back, you were just as negligent to get on a drunk man's back. Put another way, he should have known not to carry you and you should have known not to trust that he could carry you.

That said, you may have a case against the designated driver, if that person was also your designated driver. If you can show that the designated driver was there as much for you as the guy who dropped you, then I think you can make out a duty of care on the designated driver's part to ensure that not only did he drive you there and back, but also to get you back to the car safely when you were drunk.
