what are the limitions on an injury that occured in a daycare

my son broke his arm in three pieces at a lic. daycare in 2004 ... the doctor whom did surgery on him filed a complaint with the state due to the ask the daycare gave about the injury and my son still to this daycare has problems with his arm.

If you are talking statute of limitations it is usually three years from the date of the incident. If you are talking limitation on damages there is none unless you signed some limitation when you put your son there.
