If the insurance company is willing to pay you for your loss (out-of-pocket dental costs, time off work, and pain and suffering), that means that the store IS responsible. The reason for insurance is to pay for the negligent mistakes made, in this case, by the store that sold you that.

If you had teeth destroyed -- especially if you have witnesses -- you should talk to a good personal injury lawyer in your area. Generally, personal injury lawyers will talk to you without charging anything, and usually work on a contingency fee, or a percentage of what they can get for you. The insurance companies, on the other hand, know that YOU don't know the value of your claim, and will ordinarily manipulate you. You're better off starting with a lawyer now, rather than later.

If no lawyer will take your claim, by the way, that's usually a sign that it may not be such a good claim, for whatever reason. Lawyers should tell you that, if that's the case, although some won't say. Also, please note that all claims have time limits. If you wait too long, you can lose whatever rights you may have to compensation for this injury.
