Legal Question in Real Estate Law in Washington

Had a 6 year relationship with a contractor. He offered to help remodel some homes over those years. I paid him for his labor and for the materials. We are no longer together, and now he believes I owe him 1/2 the profit from the sale of those homes. He took no risk, there was no contract, his name was never on any mortgage and I provided shelter throughout those years for he and his 3 children.

Does this case have any merit?

Based on the facts as you relate them, if I were a judge, I'd say the contractor/ex-boyfriend is out of luck. If he wants to press for what we would call equitable damages, claiming that he should be entitled to more for doing the work he did, then you could also ask for equitable relief, such as for unpaid rent for the time he lived under your roof.

I think the fact that you two were romantically involved also tells a judge that perhaps his claims are motivated more by lover's quarrels (which are often not financially compensable) then actual contractual, equitable, or legal claims.

One thing to keep in mind. If for some reason he does sue you, be prepared to have your proof of what you paid him. Hopefully, you wrote checks to use to now prove you paid him for the work, and all the supplies used. Otherwise, start digging for your receipts. You will want to know where those are now, rather than after he sues you, sending off a mad rush to find documents.
