Legal Question in Criminal Law in West Virginia

Bribery

What if an officer, specifically a federal agent, contacted a person and said they had built up a case on them for drug distribution. They then said if the person paid them a certain amount of money, then they wouldn't get in trouble. If the person declined their offer and the agent brought a so-called case against them, could the person use the bribery allegations against the agent, especially if they had proof?

Re: Bribery

I wouldn't be asking that question over the internet. But, in answer to your question, if there is a case for drug distribution then the fact that the federal agent tried to solicit money in exchange for allowing the operation to continue, isn't going to help much in the case against the dealer unless the feds: (1) believe the drug dealer, and (2) want to prosecute crooked federal agents more than drug dealers.
