Legal Question in Civil Litigation in West Virginia

Primary/secondary buyer issues. Please help

I truely need some advice for this problem. This is when I was staying in Georgia so I'm not to familiar with the states laws.

In 2000 a friend and I purchased a vehicle. Since he had no credit the dealership used me as the Primary buyer and him as the Secondary buyer. Near the end of the year (2000) I moved back home to WV. Ever since then I've tried to get him to refinance the car so my name will be off of the paperwork. He says he won't refinance because he doesn't want to have to pay more on the vehicle than what the monthly payments are now or he was told he doesn't have enough credit to get it refinanced (as he says). My questions are: Since I'm a primary, am I able to take the car from him and refinance it or sell it up here in WV? He IS the one who has made all payments for the vehicle and he also wants to keep the car. I do not mind giving him all rights to the car just as long as I can have my name taken off of the paperwork. But he just won't cooperate. Please, I need some advice. Thanks.

If your name is not on the title, you have no right to pick up the car.
