Legal Question in Personal Injury in West Virginia

Insurance Problem

Recently I had been rear-ended by another vehicle. I obtained the driver at fault's information and contacted his insurer. They requested an estimate of my vehicles damages, so I took my car to a well respected body shop and faxed the estimate to the insurance company. Weeks went by and they would not contact me, I left numerous messages throughout that time to no effect. Finally after contacting them, they want to send claim adjusters to my home. They are very rude,treating me like a criminal, and doing everything in their power to not give me the money to fix my vehicle. What can I do to protect myself and get the money to have my car properly repaired?

With respect to the damage to your vehicle, you can either accept the insurance co.'s offer or run it through your own insurance co. (since the accident was not your fault, your rates won't be affected and your insur. co. will deal with the other insur. co for you). If you suffered any bodily injuries, then you should seek medical attention and retain an attorney.
