Legal Question in Wills and Trusts in West Virginia

My father passed last summer. There was a house, property and personal property left. 50% was supposed to go to the girlfriend, 25% to my sister and I each. The county clerk said the will was not good because it was not the original and that everything was left to my sister and I. It came out of probate and the girlfriend is living in the house. We want to sell it because we are tired of her living there free and us paying the mortgage. Can we evict and how? What are our legal rights? This is in the state of WV. Thank you.

You and your sister should consult a lawyer. It is possible to probate a copy of a will. You have other rights that could be enforced.
