Legal Question in Disability Law in Wisconsin

disabled child was discriminated at the ymca

My daughter has spina bifida, she can use the bathroom on her own, but she still wears diapers. We took her to the YMCA's child care facility and they told us that she had to be with the babies because she was still in diapers. The manager of child care said that they had a meeting recently about this subject. Then she told us that they weren't ''equipped'' to handle kids like her in the facility for big kids. Supposedly there was a lady that worked there that works with special needs children, but they couldn't watch over my child. My daughter is capable of using the bathroom on her own and changing her own diaper, I just don't understand why they took her out of the facility with the big kids when she doesn't need help using the restroom. I asked the manager what they weren't equipped to do and she wouldn't answer the question. I felt like they discriminated against me and my child. My child was crying because she wanted to be with the kids she can talk to and her age. I was hurt i burst into tears as well and i think something should be done so I was wondering if there was anything that I can do about it or if i had a case?

Have you tried calling Disability Rights Wisconsin?

This is from their website: "Disability Rights Wisconsin is a private non profit organization which was founded in 1977. Designated by the Governor to ensure the rights of all state citizens with disabilities through individual advocacy and system change, DRW is part of a national system of federally mandated independent disability agencies. DRW is completely independent of government and the disability service system in order to be free of any conflicts of interests which would undermine our capacity to advocate vigorously on behalf of the human and legal rights of people with disabilities.

Disability Rights helps people across Wisconsin gain access to services and opportunity through its advocacy and legal expertise. We regularly challenge systems and society to create positive change and improve the lives of people with disabilities.

Committed board and staff members are among the strongest advocates in the state. We support the right of each person to live in dignity, to work and to attend school in the mainstream of society.

The agency also works on disability issues with state and local governments. Disability Rights Wisconsin receives financial support from individuals and private foundations and from training fees and government grants."
