Legal Question in Consumer Law in Wisconsin

My Car may be a Lemon

I leased a new chrysler on 11/29/2006. I currently have 26,000 miles on the car and I have be having a problem with the car. It makes a howling noice when it accelerates. I have had it in the dealership now 4 times to fix the problem and they can not fix the problem because they dont know what is wrong. They have torn the car apart a couple of times now, but that has not fixed the problem. The dealership finally told me not to worry about it because it is a leased car and that it will still be under warranty when i return it. however, my car will be out of warranty before i return it because i paid for extra miles. I have contacted chrysler about the problem and they told me they would call the dealership to help things along. nothing has been done yet, and the dealership has left it at ''we will get back to you if a bulletin comes out concerning the problem.'' Is there something that can be done? Or am i stuck with a 40k car?

Lemon Car Which Howells During Accelleration

Lemon Car Which Howls During Acceleration

The WI Lemon law has a very short statute of limitations for the owner to make a demand that you be allowed to return the vehicle for replacement--possibly only one year--and is additionally only available after a requisite number of repair attempts by the dealer or out of service days. The WI Lemon law also only applies to brand new vehicles. Outside of that, there are other options for suing such as the Moss-Magnusson act, but that has the drawback of not awarding attorneys fees the way that the WI Lemon law does. However, under either theory, the consumer must prove that the vehicle is defective. I am not sure that howling noises during acceleration would necessarily qualify as a significant enough defect sunless it somehow prohibits full use and enjoyment of the vehicle. My comments here are not legal advice and do not create an attorney/client relationship.
