The association needs to hire a lawyer, and instruct the lawyer to threaten suit against the offending owner which suit would ask an injunction ordering that the offending structure be taken down. The lawyer would first need to review the Association Bylaws and Rules to make sure that it is truly illegal. The rules might also allow the association to charge the offending owner for the expenses of the litigation.
