Legal Question in Administrative Law in India
I was awarded promotion on 2013 DPC in April,2013.
Refused to go transfer. In the next DPC , my junior promoted to the home station. I am debared for one year. But in list my name is on NO.9 and my junior name is on no. 13. My question is a) Can i go to court due to injustice occured against me in this respect. b) Wheather seniority will maintain according to this DPC (2014) where my name is upper.

Dear Sir / Madam,
a). You may approach the Court, but your application might not sustain, since you have yourself turned down the promotion & transfer which was offered to you, as a result of which no injustice has been done.
b). It remains at the discretion of the DPC, since it is performance based and merit linked.
