Legal Question in Administrative Law in India
My Brother-in-law's Uncle is harassing my sister that she has stolen a necklace from his house 3 months back. My Sister used to visit the house very frequently and she selected the design of jewels and ordered it from jwele shop, took it to give to his house. Brother-in-laws uncle is harassing my sister saying he will go to police based on finger prints on jewel box. Since my sister is the one who ordered it, the jewel box will have her finger prints. Can police question or file a case against her based on finger prints on box.

No, proof is not sufficient to lodge an FIR. If a complaint is registered, police has to first verify whether the jewel is lying with her. A search warrant will be issued. Merely finger prints on box is not sufficient.

Finger prints vanish within 24 hours so nothing can be done based on finger prints.
