Legal Question in Administrative Law in India
Dear Sir / Madam,
Our's is a Registered Co-operative Housing Society of 24 flats. Out of which almost 15 flats have been given on rent for their Flat Owners. Now just remaining 10 flat holders are residing as Owner in the society.
Presently there is no any Committee formed by us because Anybody is not ready to take the responsibility as Committee Member like Authorized person for the society. Please let us know how can we do the Business of the Society without of Committee. Is there any option to handle the society matters without of committee.
1 Answer from Attorneys
1) It was mandatory for the builder to register a cooperative society before giving possession of the flats to purchasers. "Maharashtra Ownership of Flat Act 1963 makes it mandatory. The builder was informed to register the society. But it is the responsibility of the deputy registrar of the cooperative societies to initiate steps and ensure registration of the society.
2) If not heavy penalty will be imposed.
