A married woman left home with 3 children with another man.Now got caught by police and got released. Now her husband is demanding all children.My question is will she able to file divorce case and get atleast one child also some amt on monthly basis....

the women eloped with another man with the kids??what was her reason for leaving her husband???i will need to know detailed facts to advice whether she can seek divorce and the issue relating to childrens custody.for further query contact 9312411481

solitary act of extra marital does not ipso facto constitute adultery as per law one must be living in adultery in this situation u may retain the custody of children and can claim other rights viz maintenance, residence protection
