Legal Question in Administrative Law in India
I am at present living with my wife in my daughter's flat. We are senior Citizens. THIS FLAT IS REGISTERED IN MY DAUGHTERS NAME ( First Holder) jointly with her husband. We do not get along with our son in law. My daughter along with her husband live in a separate flat.
Now the problem is, in the case of a accident or untimely death of my daughter, her husband may ask us to vacate the flat. What precautions should we take so that this does not happen. We have a Notarized Affidavit on Rs. 100/- stamp paper stating that she has consented to our staying in her flat. We are residing in this flat since two and half years, We reside in Pune, India
1 Answer from Attorneys
1) Notarized affidavit will not serve the purpose.
2) The share of ur daughter can be gifted to u both.
After ur death, u can write a will as per ur daughters wish.
