Legal Question in Administrative Law in India

Raman and his family went to Connaught Place / Delhi for enjoying a stroll, shopping and dining on a Saturday evening. After chilling out enough they were returning to Gurgaon by Metro. At Gurgaon station Metro stopped short of platform by about 10 metres. As a result the second door of the last coach (which had Raman family) did not have benefit of platform. As Ramans son (Krishnan, a JNU student) was rushing out to exit from the second gate, Raman shouted at him to go slow and to see clearly before stepping out. Unfortunately Krishnan did not pay much attention to what his father said, hurriedly got out of Metro, fell on track, and suffered a fracture in his leg. Krishnan moved the court for compensation from Metro for its negligence. In the trial he admitted that his father warned him and but he did not listen. Will Krishnan still win?

Yes, Krishnan will still win the plea, in view of it being the duty and responsibility of the Metro Railways to ensure that the platform accommodates the entire length of the train. (Reply No. 2-August, 2013).
