Screwed up by a paralegal

our paralegal took our money for filing the documents for immigration (based on marriage). Our verbal aggrement is: to send out doc. by 1/2/08. But she did not send the documents till 5/28/08. And she kept lying till we found out the delay. If we are ganna sue her for deception,is there any chance we can win? And how long it will be. Thank you.

As with many proposed lawsuits, there is a three-step analysis before deciding to proceed:

(1) Are we likely to win?

(2) Are we able to plead and prove enough damages to make it worthwhile?

(3) Will we be able to collect our judgment from the losing defendant?

As to #1, you may have a pretty strong case based on breach of contract, negligent performance of duties or unauthorized practice of law, but as to whether your sustained any significant damages or could collect from the paralegal, I have no information upon which to make even a guess.

As you might know, only licensed attorneys are permitted to practice law. If you were to sue this individual, there is a law that gives you extra damages because she did not have the required license. The issue in your case is whether you will be able to collect any money you might win in court.
