Legal Question in Administrative Law in India
Sir, One of my colleague is an Central Govt. employee spinster. Sine her sister too was a spinster she declared her has the nominee and later She adopted younger sister's daughter. After her retirement she died and since the adopted child was minor . Adopted daughter being minor the office told that a succession certificate is required to pay the terminal benefits to the adopted girl's mother.. I wanted to know when the deceased had adopted and declared why do we need the succession certificate and is it necessary/ kindly clarify and reply me back.

1) As per records first her sister was the nominee.
2) Later, the mother who died in testate adopted a girl who is still a minor.
3) The terminal benefits and the property shall now inherit to the minor adopted girl.
4) Yes. The legal heir certificate or succession cert from the court is necessary.
5) The court will appoint the legal guardian till the minor attain majority.
