Team,

Can the Secretary of a Co-operative Housing Society in Mira Road, Thane Dist., Maharashtra State, India, refuse to give acknowledgement for Nomination Forms submitted to him over 9 months back. Annual General Meeting was held in October 2013 but nothing were done to Nomination Forms pending. Even recently on 11th May 2014 he refused to give it stating he is going out of the state for next 2 weeks it will be discussed on 27th May. On 27th May 2014 when approached his position is the same. What will happen if anything God forbid happens to my sister who had nominated me? Can the Secretary be held liable to complete the Nomination process.

Can I lodge an FIR against him at the nearest police station?

Dear Anil,

It remains the duty of the Hon. Secretary to accept Nomination Forms from members and to issue an acknowledgement thereto. The Nomination has to be placed in the Managing Committee meeting and the General Body meeting of the Society and approved thereat. The Nomination has to be recorded in the Register and the same along with entry number has to be furnished to the Member by the Hon. Secretary of the Society. If the Secretary fails to fulfill his duties, you can lodge a complaint to the Dy. Registrar of Co-operative Housing Societies to intervene and resolve the matter.
