old blank cheque not dated signed by the party can be come under the ambit of u/sec 138 can we put for refund now

Dear Sir / Madam,
Yes. If the cheque is dishonoured, you have a valid reason to file a recovery suit under Section 138 of the Negotiable Instruments Act.

It can be filled up for the amount owed by the drawer and dated too, if such a cheque is dishonoured you can proceed under Sec.138
