I and my brother made home at my elder brother name and he took bank loan on that property l have done court case can the auction of such disputed property be. ?

If you are able to establish that the property was acquired out of contributions by members of a joint Hindu family in the elder brother's name as Kartha of the family in a suit against your brother for partition I pleading your brothers and the bank as well, you can prevent the property from being sold as a whole except your elder brother's share in the same.
