cheque is presented in bank after its validity i.e. after three months, and cheque is return due to drawers signature`s differs, lender has filed a complaint under section 138 of negotiable instrument act, and honorable court grant the relief of complainant.
respected sir i need a judgment related with the validity of cheque, if cheque is presented after three months ( i.e. after its validity) negotiable instrument act`s section 138 is not applied to in than case, please do needful in this matter.
i also found many judgement but mostly ruling shows the validity of cheque is six (6) months.
so please provide me latest ruling of cheuqe is valid for three months. and if its presented before bank after its validity negotiable instrument act not applied

If the date of your cheque is older to the revised instructions of RBI limiting its validity period to 3 months, You don;t have a case to contest. Please honour your commitments and have the case compounded.
