cheque returned with memo refer to drawer. does it come under NI act. shall i be able to file a complaint and sue the drawer with in this act

Dear Sir / Madam,
Yes, a cheque returned by the Bank with any reason comes under the purview of Section 138 of the Negotiable Instruments Act. You are legally entitled to sue the drawer for cheque dishonour.
