Legal Question in Banking Law in India

Dear Sir

A Limited Company signed a three year sales agreement with my firm on judicial stamp paper. As per that agreement they were suppose to give me 5% commison on dealer sales and 10% commission on Industrial sales. We statred promoting the sales of company. As this was a new company in the market,we worked very hard to promote the products of the company and all went very smoothly for 1 one and half years. Our payments were going very smootly through bank.In the meantime company very softly asked us to give them blank security cheque which we gave blank with the name of company filled by us.After getting that cheque, company statrted playing dirty games with us by appointing other distributor without our knowlege. When this came to our notice we raised the voice with the company,s management and we were told that as per agree ment they will give us commission and when we asked them to send us the copies of bills of new parties other than our parties their was no answer from their side and they even stopped supplies to us and started selling material direct in the market and they filled our security cheque without giving us any commission. That cheque was bounced from the bank as our payments were also struck up in the market. You are requested kindly guide us on this matter. Our security cheque number is very much before the numbers we gave to them and cheques given after that are already cleared.

You have to contest that the cheques are not for discharge of any debt. Engage a good lawyer in your locality and contest the claim.
