Legal Question in Banking Law in India
Factory assets were fully mortgaged with Bank. In OA to DRT, Bank has confirmed that the loan is given against this mortgage only. My residence was under negative lien with value mentioned. Original title deed is with me.The case for recovery is going on in DRT/RO.Factory assets could not still be sold by Bank. But Bank has filed application for attaching my residence. OA order says that I can not transfer the rights till loan is fully paid. Question is : Under this situation, can the Bank ask for attachment of my residence ?
