Can we file caveat in Magistrate court so that if Bank file a case to take possesion of property than we should be serve notice before permitting bank to take possesion.

sorry, you cannot file caveat in a criminal matter proposed to be filed in the magistrate court.

Yes you can file the caveat. But only for matters of Civil in nature.

The Cr.P.C. does not provide for caveat. Yet some courts permit it. Generally no caveat can be filed as per law.
