Legal Question in Banking Law in

I gave a cheque to a person as security agianst the cash he gave me.I gave him the cheque in one of his friend's name(whom I did not know.)I paid him back in 2006.I did not ask for return of cheque without suspecting anything foul on his part.i closed my account in feb. 2007.In july 2010 his friend presented the chq,(writting the date 10-03-2010 in his own hand-writting.) and was returned with the reason'account closed.Please advise me---

1.Will the complainant have to prove the consideration for he was given cheque.?

2. If he says it was against a friendly loan--A.--Does friendly loan have any legal value, if there is nothing in writting.?, B.--please guide me about 'friendly loan.

You have fair chance to quash the prosecution. You require t do certain thing. A case has been filed or not?

As far as security cheque is concern, it can not be used for prosecution of drawer.
