Dear Sir / Madam,
Police are empowered to arrest a person who is suspect of any cognizable offense. The Offense under section 420 of the Indian Penal Code is a cognizable offense. Hence, Police may arrest the accused but they are bound to produce the accused before the Court within 24 hours. It is their legal and constitutional duty. When any accused is produced before Court, only the Court can decide whether the accused should be given police custody remand or magisterial custody remand or whether the accused may be released on bail. The accused has one more remedy to approach District court to get anticipatory bail. The District Court can grant even interim anticipatory bail to the accused.
